Terms of Service

These terms are an agreement between you and DesiClasses ("DesiClasses", "we", "us"). They apply when you browse the site, create an account, contact a teacher, or list classes with us. By using DesiClasses you agree to them. If you do not agree, please do not use the service.

1. What DesiClasses is, and what it is not

DesiClasses is a directory and marketplace for Indian cultural classes. We help families discover teachers and academies, and we pass on enquiries to them. In the future we expect to let families book and pay for classes through the platform.

We do not teach.DesiClasses does not provide, own, run, supervise, or control any class, lesson, camp, or event listed on the site. Every class is provided by an independent teacher, academy, temple, studio, or other organisation ("Providers"). Providers are independent businesses. Nothing in these terms creates an employment, agency, partnership, or joint venture relationship between DesiClasses and any Provider, and no Provider may hold itself out as acting for DesiClasses.

When a family arranges a class with a Provider, that arrangement is directly between them. We are not a party to it, even where we passed on the enquiry, hosted the messages, or (in future) processed the payment. If we later offer booking or payment features, we act only as a technical and payment facilitator for the Provider, not as the provider of the class.

2. Who may use DesiClasses

You must be at least 18 years old to create an account. Accounts are for adults: a parent or guardian may enquire about classes on behalf of a child, but children may not create accounts or use the site themselves. You agree to give accurate account information, to keep your password secure, and to tell us promptly at support@desiclasses.com if you believe your account has been used without your permission. You are responsible for activity under your account.

3. For parents and students

When you express interest in a listing, you are asking us to pass your details to that Provider so they can contact you. The details you submit, which may include your name, email address, phone number, your child's first name and age, your location, and your message, are sent to the Provider by email, SMS, or WhatsApp. Only submit a child's details if you are their parent or guardian, and only submit what you are comfortable sharing with that Provider.

Choosing a Provider is your decision. You are responsible for satisfying yourself that a Provider is suitable, qualified, and safe for your child, including any questions about licences, insurance, references, supervision, and background checks. Please see section 9.

4. For teachers and academies

If you submit or claim a listing, you represent and agree that:

  • You are authorised to act for the business you are listing or claiming, and to accept these terms on its behalf.
  • Everything you give us about your classes, including your description, teacher details, locations, formats, schedule, and fees, is accurate and kept up to date.
  • You hold every licence, registration, permit, insurance, certification, and background check that the law of your state or municipality requires for teaching the classes you list, particularly where those classes involve children, and you will keep them current for as long as your listing is live.
  • You will comply with all laws that apply to you, including those on child safety and protection, non-discrimination, advertising, consumer protection, and tax.
  • You own the rights to the photos, text, logos, and other material you upload, or you have permission to use them, and they do not infringe anyone else's rights.
  • You will tell us promptly at support@desiclasses.com if any of the above stops being true, including if you are charged with or convicted of an offence involving violence, fraud, theft, or sexual misconduct.

Providers set their own fees, schedules, curriculum, and policies, and deal directly with families. We do not supervise your classes or direct how you teach.

5. Listings we compile, and claiming a listing

Many listings on DesiClasses were compiled by us from publicly available sources, such as a Provider's own website, public social media profiles, and public business listings including Google Maps. A listing being on the site does not mean the Provider asked to be listed, endorses us, or has any relationship with us.

If a listing is about your business and you want it changed or removed, email support@desiclasses.com and we will act on it. You do not have to claim a listing or create an account to ask.

When you submit a listing or claim an existing one, you authorise us to compile and refresh the details of that listing from your public web presence, so we can keep your page complete and current. We make a reasonable effort to get this right, but details drawn from public sources may be incomplete or out of date, and you remain responsible for reviewing your listing and correcting it. Once your listing is claimed, you can edit it from your dashboard at any time.

6. Your content, and the licence you give us

You keep ownership of everything you upload or submit ("Your Content"). You grant DesiClasses a worldwide, non-exclusive, royalty-free, sublicensable, transferable licence to host, store, reproduce, adapt for display, publish, and distribute Your Content in order to operate, promote, and improve the service. That includes showing your listing in search results, on category and city pages, in structured data that search engines read, in our own marketing, and in emails and messages we send about your listing.

This licence lasts while your content is on the site and for a reasonable period afterwards for backups and cached copies. It ends for active display when your listing or content is removed, except for copies already distributed to third parties such as search engines.

We may show public information about a Provider that we did not create, including ratings and review counts sourced from Google. Those reflect their source and not our opinion. We may also decline to publish, edit for length and format, or remove any listing or content at our discretion, including content we consider inaccurate, unlawful, unsafe, or unsuitable for a directory used by families.

7. Enquiries, contact details, and family data

When we pass an enquiry to a Provider, it carries personal information about a family, which may include a child's first name and age. If you are a Provider receiving enquiries, you agree that you will:

  • use those details only to respond to that family about their enquiry and any classes they go on to take;
  • not sell, rent, or otherwise disclose them, and not add them to marketing lists without that family's consent;
  • keep them secure, keep them no longer than you need them, and delete them on request where the law requires;
  • comply with all laws that apply to handling personal information, including information about children; and
  • comply with all laws on marketing calls, texts, and messages.

By listing with us and providing a phone number, you consent to receive service messages from us about your listing and your enquiries by email, SMS, and WhatsApp. You can opt out of SMS and WhatsApp at any time by replying STOP or by contacting us, though we will still need to email you about your account.

8. Acceptable use

You agree not to:

  • list classes you do not actually offer, or claim a business you are not authorised to represent;
  • post anything false, misleading, defamatory, obscene, discriminatory, or unlawful;
  • impersonate anyone, or misrepresent your qualifications, affiliations, or experience;
  • harass, abuse, or endanger any other user, or contact families for anything other than their enquiry;
  • scrape, crawl, or bulk-copy the site or its listings, or use them to build a competing directory;
  • upload malware, probe or interfere with the security of the service, or bypass access restrictions; or
  • use the service in any way that breaks the law or these terms.

9. No vetting, no endorsement, and safety

We do not run background checks on Providers, and we do not verify their qualifications, licences, insurance, references, or criminal history. We do not inspect premises or observe classes. Being listed on DesiClasses is not a recommendation, endorsement, certification, or guarantee of any Provider, and any badge, ranking, ordering, or "featured" placement on the site says nothing about a Provider's suitability or safety.

Deciding whether a Provider is right for your family is your responsibility. We encourage you to meet the teacher, visit in person, ask about their training, insurance, supervision, and child-safety practices, ask for references, and use your own judgement. This matters most where classes involve children.

10. Fees and future bookings

Listing on DesiClasses and contacting Providers are currently free. We may introduce paid features, including booking and payment for classes through the platform, subscriptions, or promotion for Providers. We will tell you the price and terms before you are charged for anything, and you will never be charged for a paid feature you have not agreed to. Where we process a payment for a class, we do so as a facilitator for the Provider. The class itself is still provided by the Provider, and the Provider's own cancellation and refund policy applies unless we tell you otherwise in writing at the time of booking.

11. Intellectual property

The DesiClasses name, logo, site design, written guides, and software are ours and are protected by intellectual property laws. These terms do not give you any right to use them except to use the service as intended. If you believe material on DesiClasses infringes your copyright, email support@desiclasses.com with enough detail to identify the material and your rights in it, and we will review and act on it.

12. Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that listings are accurate, complete, current, or available, that any Provider will respond to an enquiry, hold a class, or meet your expectations, or that the service will be uninterrupted or error-free. Listing details, including those compiled from public sources, may be wrong or out of date. We are not responsible for the conduct of any Provider or family, online or offline, or for the quality or safety of any class.

13. Limitation of liability

To the fullest extent permitted by law, DesiClasses and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the service.

Our total liability for all claims relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or one hundred US dollars ($100). Some states do not allow certain limitations, so parts of this section may not apply to you, and nothing here limits liability that cannot be limited by law.

14. Release between users

DesiClasses is not a party to dealings between families and Providers. If you have a dispute with another user, you will pursue it with that user and not with us, and you release DesiClasses from all claims, demands, and damages of every kind arising out of or connected with that dispute.

15. Indemnity

You agree to indemnify and hold DesiClasses harmless from any claim, liability, loss, and reasonable legal cost arising from your use of the service, your content, your classes, your dealings with other users, or your breach of these terms or of any law.

16. Suspension and termination

You may stop using DesiClasses and ask us to close your account or remove your listing at any time by emailing support@desiclasses.com. We may suspend or remove an account or listing, with or without notice, if we believe it breaches these terms, is inaccurate or fraudulent, or presents a risk to families or to the service. Sections that by their nature should survive, including licences already granted for distributed copies, disclaimers, limitation of liability, release, and indemnity, survive termination.

17. Changes to these terms

We may update these terms as the service changes, including when we introduce bookings and payments. We will update the date at the top, and for material changes we will give reasonable notice by email or on the site before they take effect. Continuing to use DesiClasses after that means you accept the updated terms.

18. Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Before filing anything, please email support@desiclasses.com and give us thirty days to resolve the issue with you directly, which settles almost everything. If that does not work, you and DesiClasses agree to the exclusive jurisdiction of the state and federal courts located in Texas.

19. General

These terms, together with our Privacy Policy, are the entire agreement between you and DesiClasses about the service. If any provision is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not transfer these terms; we may transfer them to a successor if the business is sold or reorganised.
